Terms of Use
These terms govern your use of the games, apps, and websites published by DIZZYWALK RECORDS LLC ("Dizzywalk", "we", "us"). By using our games or sites you agree to these terms. If you do not agree, do not use them.
1. License to play
We grant you a personal, non-exclusive, non-transferable, revocable license to use our games for your own non-commercial entertainment, subject to these terms and any applicable app-store terms. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works from our games or their assets except as permitted by law.
2. Ownership
All game software, artwork, audio, characters, names, and other content are original works owned by DIZZYWALK RECORDS LLC or its licensors and are protected by intellectual-property laws. "Dizzywalk" and the game names are used to identify our products. All rights not expressly granted are reserved.
3. Acceptable use
You agree not to use our games or services to break the law, infringe others' rights, cheat or manipulate leaderboards, submit unlawful or offensive content (including in any display name, topic, or share text), attempt to disrupt or gain unauthorized access to our systems, or interfere with other players. We may sanitize, remove, or refuse content and may suspend access for violations.
4. User-submitted content
Some games let you submit content such as a leaderboard display name, a topic, a monster name, or a share code. Do not include personal or sensitive information. You are responsible for what you submit, and you grant us a license to store and display it as needed to operate the relevant feature (for example, showing a leaderboard). We may remove content that is unlawful, abusive, or otherwise violates these terms.
5. Privacy
Your use of our games is also governed by the per-game privacy policies, which explain what each game does with data.
6. Availability & changes
Our games and services are provided on an "as available" basis. We may add, change, suspend, or discontinue any game, feature, leaderboard, or online service at any time, including for games not yet publicly released. We may update these terms; the effective date above will change and continued use means you accept the update.
7. Disclaimers
To the maximum extent permitted by law, our games and services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the games will be uninterrupted, error-free, or secure.
8. Limitation of liability
To the maximum extent permitted by law, DIZZYWALK RECORDS LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use our games or services.
9. Governing law
These terms are governed by the laws of the State of Nevada, USA, without regard to its conflict-of-laws rules, except where a mandatory consumer-protection law of your place of residence applies.
